Court Services - Adoption
 
An adoption is a special legal proceeding that creates a relationship of parent and child between a petitioner and the adopted person. The petitioner in an adoption proceeding is the person who wants to become the parent. The adopted person is usually a minor child; however, in very limited circumstances, an adult can be adopted. It is the responsibility of the Probate Court to make sure a child is placed in a safe, loving and permanent home.
General Information
There are various types of adoptions which can pass through the Probate Court. The determination of which type depends on the facts in each adoption.

A filing fee is required when filing an adoption. The amount of the fee is based upon the type of adoption you are filing. There may be additional court costs required during the adoption process. We do not accept credit cards.

We accept filings in person or by mail. If you wish for any file-stamped documents to be returned to you, a self-addressed, stamped return envelope should be provided to the Court.

The Miami County Probate Court personnel are prohibited by law to provide legal advice or to assist in filling out forms.

Three major types of Adoptions are:
  1. Adoption of Minor Petition
  2. Pre-Placement Adoption
  3. Adult Adoption
  4. Request for Foreign Birth Record

Adoption of Minor Petition
A birth certificate must be filed with the adoption petition.

If the child to be adopted was born after 1/1/1997 and the birth mother was not married to the birth father and no subsequent paternity determination was made after the birth of the child, the Court requires a Putative Father Registry Certification.

ODHS Form 1693 (Ohio Law and Adoption Materials) may need to be filed and is to be completed by the adoption assessor and the birth parent(s).

If the minor was born outside the state of Ohio, you will need to provide the court with the address of the Vital Statistics Department for the minor’s birth state at the time of filing the petition.
Requirements after Court Hearing
If the minor was born in Ohio, the Court will send a certified copy of the Vital Statistics Certificate of Adoption to the Ohio Department of Health, Special Registrations. If the minor was born outside the state of Ohio, the Court will send a certified copy of the Vital Statistics Certificate of Adoption to the Department of Vital Statistics for that state. In order to obtain a new birth certificate, you will need to contact the capital of the state where the minor was born for the proper procedure.

Pre-Placement Adoption
The birth parent(s) may be represented by legal counsel. The legal counsel for the birth parents may not be the same person who represents the prospective adoptive parents.

If a birth certificate has been issued, it must be filed with the pre-placement application.

If the child to be adopted was born after 1/1/1997 and the birth mother was not married to the birth father and no subsequent paternity determination was made after the birth of the child, the Court requires a Putative Father Registry Certification.

ODHS Form 1693 (Ohio Law and Adoption Materials) should be utilized at the time of the birth parent assessment and is to be completed by the adoption assessor and the birth parent(s).
Requirements after Court Hearing
Once the entry is rendered, the attorney for the prospective adoptive parents may file the Petition for Adoption.

Adult Adoption
In accordance with R.C. 3107.02, a petition for adoption of an adult may only be filed if:
Adoptee is totally and permanently disabled;
Adoptee was determined to be a mentally retarded person; or
Adoptee established a foster child/foster parent or stepchild/stepparent relationship with petitioner as a minor.

A birth certificate must be filed with the adoption petition.

If the adult adoptee was born outside the state of Ohio, you will need to provide the court with the address of the Vital Statistics Department for the adult adoptee’s birth state at the time of filing the petition.
Requirements after Court Hearing
Once the entry granting the adult adoption is signed by the Judge, the Court will send a copy to the adult adoptee or his attorney.

If the adult adoptee was born in Ohio, the Court will send a certified copy of the Vital Statistics Certificate of Adoption to the Ohio Department of Health, Special Registrations. Request for Foreign Birth Record
A person(s) who has adopted a child pursuant to an adoption decree or certificate of adoption issued outside the United States and recognized in this state, may request the Probate Court in the county in which the person(s) resides to order the Department of Health to register the foreign decree and to issue an Ohio birth certificate. The applicant must submit proof that the Department of Homeland Security (Immigration and Naturalization) has approved the foreign certificate or adoption decree. (Proof may be by means of Certificate of Citizenship.) Please contact the court for additional documents which may be required.
Requirements after Court Hearing
Once the Order to Issue Foreign Birth Record is signed by the Judge, the Court will send a copy to the applicants or their attorney.

The Court will send a certified copy of the Order to Issue Foreign Birth Record and the Vital Statistics Certificate of Adoption to the Ohio Department of Health, Special Registrations.
