Court Services - Change of Name
 
A name change is an amendment to the birth certificate; it does not change the original birth certificate.
General Information
A filing fee is required when applying for a change of name. There may be additional court costs required during the change of name process. We do not accept credit cards.

We accept filings in person or by mail. If you wish for any file-stamped documents to be returned to you, a self-addressed, stamped return envelope should be provided to the Court. We prefer filings to be in person as a valid I.D. must be presented at the time of filing.

The Miami County Probate Court personnel are prohibited by law to provide legal advice or to assist in filling out forms.

The two types of name changes are:
  1. Change of Name for an Adult
  2. Change of Name for a Minor

Change of Name for an Adult
A person desiring to change his or her name must be a resident of Miami County for the past twelve (12) months prior to the filing of the application.

A valid I.D. from the Applicant must be presented at the time of filing the application.

A hearing date will be scheduled either at the time of filing or at a later date.

You are responsible to publish the legal notice in a newspaper of general circulation in Miami County at least thirty (30) days prior to the hearing date. It is your responsibility to make sure the proof of publication is returned to the probate court. If it is not returned prior to the hearing, the case may be dismissed.

If you were born outside the state of Ohio, you will need to provide the court with the address of the Vital Statistics Department for your birth state at the time of filing your application.
Requirements after Court Hearing
Once the entry granting the name change is signed by the Judge, the Court will provide certified copies to you or your attorney.

If you were born in Ohio and are changing your name to a name other than your birth name, the Court will send a certified copy of the Judgment Entry for Change of Name to the Ohio Department of Vital Statistics. They will attach this form to your birth record. No new birth record is issued. You will need to contact the Ohio Department of Vital Statistics to obtain a certified copy of your birth record at (614) 466-2531 or use the following link to obtain further contact information:



If you were born outside the state of Ohio, the Court will send a certified copy of the Judgment Entry for Change of Name to the Department of Vital Statistics for that state. You will need to check the proper procedure in that state for obtaining a certified copy of your birth record.

Change of Name for a Minor
A minor must be a resident of Miami County for the past twelve (12) months prior to the filing of the application. Applications will not be accepted for minors under one (1) year of age.

A valid I.D. from the Applicant must be presented at the time of filing the application.

The child’s original birth certificate (or a certified copy) is required at the time of filing the application.

If a birth parent is deceased, a certified copy of the death certificate if required.

Please check with the court as to consent requirements.

A hearing date will be scheduled at a later date.
