Welcome to the Miami County Probate Court website. We hope that you will find this website helpful in conducting business at Probate Court. Miami County Probate Court is a division of the Court of Common Pleas and has exclusive jurisdiction over certain types of cases including estates, guardianships (adults and minors), name changes (adults and minors), adoptions and civil commitments. The probate court also issues marriage licenses.
We have designed our website to give you some basic information about our services and access to some of our public records. We also have provided you with access to many of the forms used in Probate Court. We encourage you to use them, however, please be aware that the staff of the Probate Court is prevented by law from practicing law, and are, therefore, limited in the amount of advice that they are permitted to give.
Our staff is dedicated to serving you and will try to make your business before the court as pleasant as possible.

As of January 1, 2013, Application for Change of Name for Adult and Minor have been revised.
As of January 1, 2013, Application for Appointment of Guardian of Alleged Incompetent has been revised. A Supplemental Application for Emergency Guardian is now required to be filed along with the Application for Appointment of Guardian of Alleged Incompetent.
TAX ALERT: Ohio Estate Tax returns are no longer required for the estates of individuals with a date of death on or after January 1, 2013. However, the Ohio Estate Tax is still in effect for individuals dying prior to January 1, 2013 who have a gross estate greater than $338,333.00.
As of July 1, 2009, pursuant to Superintendence Rule 45(D)(2), when personal identifiers are omitted from a case document submitted to the Court for filing, the party who submitted the case document shall submit the omitted information on a separate form. This form is not a public record and will not be maintained with the case file or imaged on the Court’s website. This form (Personal Identifier Omission Form) is located in the court forms provided in this website.
